Privacy policy

This policy explains what UWS does with personal information when you run a shop on ShopKit. It's written to be read. If something here isn't clear, ask — support@uplink.net.au.

Who this is from

ShopKit is operated by Uplink Web Services Pty Ltd (ABN 55 699 450 452), East Maitland NSW, Australia — "UWS" in this policy. UWS is bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

Two different relationships

This matters, so it's up front.

Your information. When you sign up and run a store, UWS holds information about you — your name, email, business details, and a record of your subscription. UWS decides how that's handled, and this policy covers it.

Your customers' information. Your shop collects names, addresses, emails and order histories from the people who buy from you. That information is yours, not UWS's. UWS only holds and processes it so your shop works, and acts on your instructions. You're the business your customers are dealing with, so you need your own privacy policy telling them what you do with it — your store has a page for exactly that.

If one of your customers approaches UWS directly about their data, they'll be pointed to you, and you'll be told they asked.

What UWS collects about you

  • Account details — your name, email, business name and the store address you choose, given when you sign up.
  • Billing details — your plan, invoices and payment history. UWS never sees or stores your card number; that goes straight to Stripe.
  • Support conversations — emails and messages you send, so UWS can help and so there's a record of what was agreed.
  • Technical logs — IP addresses, browser type and timestamps, kept automatically to keep the platform secure and to work out what happened when something breaks.

UWS does not ask you for, and does not want, sensitive information as the Privacy Act defines it.

What UWS does with it

  • Runs your store and keeps it available.
  • Bills you, and keeps the records tax law requires.
  • Answers your support questions.
  • Emails you about your service — invoices, security matters, changes to this policy or the terms, and things that affect your store.
  • Keeps the platform secure and diagnoses faults.

UWS does not sell your information or your customers' information, to anybody, ever. It isn't used to advertise to you or to anyone else, and it isn't handed to data brokers.

Marketing email

If UWS emails you about new ShopKit features or offers, every message has an unsubscribe link and it will be honoured. Unsubscribing doesn't stop the emails you actually need — invoices, security notices and service messages — because those are part of the service you're paying for.

Who else touches the data

The list is kept short deliberately, and UWS only uses suppliers that handle data properly:

  • Stripe — payments and subscription billing, both for UWS and for your own shop's sales.
  • Hosting and infrastructure — the servers your store runs on, which UWS operates in Australia.
  • Email delivery — for the messages your shop and the platform send.
  • Backup storage — two separate off-site providers, each of which encrypts what it holds.

Some of these are overseas providers, so information may be stored or processed outside Australia. UWS only uses providers it considers able to protect it to a standard consistent with the Australian Privacy Principles.

UWS will also disclose information if the law genuinely requires it — a court order, a warrant, or a regulator with the power to compel it. If that ever happens you'll be told, unless UWS is prohibited from telling you.

How long it's kept

While your store is open, UWS keeps your data so the shop works.

Your database and media are backed up every day to two separate off-site providers, and those copies are kept indefinitely so that a problem discovered late can still be recovered from.

If your store closes, UWS doesn't wipe it out from under you — it stays available so you can come back or ask for an export. When you want it deleted, say so: UWS will remove the live store and its backup copies, and confirm to you when it's done. Because backups are kept indefinitely rather than ageing out, that removal happens on your request rather than by itself.

Some records must be kept regardless — invoices and transaction records, which Australian tax law requires UWS to hold for five years.

Getting your data out

You can ask for a complete export at any time, and UWS will provide it within one business day: a full database dump in a standard format, all your media files, and a guide to opening both. There's no fee and no lock-in. See the exit policy.

Your rights

Under the Privacy Act you can ask UWS to:

  • Show you the personal information it holds about you.
  • Correct it if it's wrong.
  • Delete it, subject to the records legally required to be kept.

Email support@uplink.net.au and UWS will respond within a reasonable time, and within 30 days at the outside. There's no charge for asking.

Keeping it safe

Every store is genuinely separate from every other store UWS hosts — its own data, its own files, its own address. Traffic is encrypted in transit. Access to production systems is limited to the people who operate the platform, and staff logins to your own admin are yours to control and revoke.

No system is perfectly secure, and UWS won't pretend otherwise. If a data breach happens that's likely to cause you serious harm, UWS will notify you and the Office of the Australian Information Commissioner as the Notifiable Data Breaches scheme requires.

Cookies

Your admin uses cookies that are necessary to keep you signed in and to remember preferences like light or dark mode. The analytics built into your storefront are cookieless — no cookie is set on your shoppers and nothing is stored on their device, which is why your shop doesn't need a cookie banner for it.

If you add your own third-party tracking to your storefront, that's yours to disclose to your shoppers.

Changes to this policy

If UWS changes this policy in a way that materially affects you, it will email you at least 30 days before the change takes effect. Minor corrections will just be made, and the date at the top will tell you when.

Complaints

If you think UWS has mishandled your information, email support@uplink.net.au and say so — better to hear it and fix it. If you're not satisfied with the response, you can complain to the Office of the Australian Information Commissioner at oaic.gov.au.
